These Terms of Service ("Terms") govern your access to and use of the Emerald Wellness platform, website, and related services (collectively, the "Services") provided by Emerald Wellness, Inc. ("Emerald Wellness," "we," "us," or "our"), located at 470 West Broad St, Ste 1062, Columbus, Ohio 43215.
By creating an account or using our Services, you agree to be bound by these Terms. If you do not agree, do not use our Services.
You must be at least 18 years old to use our Services. By using our Services, you represent that you are 18 or older and have the legal capacity to enter into these Terms.
To access most features, you must create an account. You agree to provide accurate and complete information and to keep your account credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@emeraldwellness.health if you suspect unauthorized access.
Emerald Wellness offers several subscription tiers: Free, Silver, Gold, Emerald Elite, and Practitioner Intelligence. Paid subscriptions are billed monthly or annually as selected at checkout and processed through Stripe.
Emerald Wellness is a health intelligence and information platform. The content, AI-generated insights, supplement recommendations, peptide protocols, biomarker analysis, and all other information provided through our Services are for informational and educational purposes only. Nothing on our platform constitutes medical advice, diagnosis, or treatment.

Our Health Intelligence Advocate is powered by artificial intelligence. AI-generated responses may contain errors or outdated information. Do not rely solely on AI responses for health decisions. Emerald Wellness is not liable for actions taken based on AI-generated content.

All content, features, and functionality of the Services — including software, text, graphics, logos, and protocols — are owned by Emerald Wellness, Inc. and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.
You retain ownership of health data you upload. By using our Services, you grant us a limited license to process and display your data to provide the Services.
Practitioners using our Pro Suite agree to use client health data only for legitimate clinical care purposes, comply with applicable HIPAA regulations, and execute a Business Associate Agreement (BAA) with Emerald Wellness prior to storing patient health information.
We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or non-payment. You may terminate your account at any time. Upon termination, your right to use the Services ceases immediately. You may request a data export before termination.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMERALD WELLNESS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Franklin County, Ohio.
We may update these Terms from time to time. Material changes will be communicated via email or platform notice. Continued use after changes constitutes acceptance.
